President’ s Foreword
Introduction
As it is often said, “ The Legislative Council (“ LegCo” ) is an epitome of Hong Kong
society.” In the past few years, Hong Kong has gone through drastic changes and
unprecedented challenges, so has LegCo. The social unrest and violence in 2019
prompted the Central Government to enact the Law of the People’ s Republic of
China on Safeguarding National Security in the Hong Kong Special Administrative
Region. Hong Kong has quickly restored its governance and social stability
from the state of chaos. The improved electoral system has ensured “ patriots
administering Hong Kong” , thereby enabling the steadfast and successful
implementation of “One Country, Two Systems” in Hong Kong. As the silver lining
started to show up, LegCo has returned to its long-awaited rationality and order
in this session. The efficiency of meetings has improved significantly, which was
in line with public expectation. I am particularly relieved and pleased to witness
from the President’ s podium that LegCo and the community are finally able to get
rid of internal rift and gradually return to the right track.

Legislative Council Annual Report 2020-2021NPCSC’ s decision on extension of the Sixth LegCo and the
change of membership
The COVID-19 epidemic situation became worse in the summer of 2020. Pursuant
to the Decision of the Standing Committee of the National People’ s Congress
(“NPCSC” ) made on 11 August 2020, the Sixth LegCo, whose term of office originally
scheduled to end on 30 September 2020, continued to discharge duties for not less
than one year until the seventh term of office of LegCo began. With the passage of
a bill to improve the electoral system, the term of office of the Sixth LegCo ended
on 31 December 2021.
While some Members decided not to continue to serve as Members of LegCo and
resigned at the end of 2020, the Members who remained in office have continued
to discharge their duties dutifully and carry out their work in LegCo in a rational and
pragmatic manner. The Sixth LegCo eventually acted in the best interests of Hong
Kong and met public expectation. When this term of LegCo stood prorogued, all
the bills that required LegCo’ s scrutiny had been completed. This was the first time
since the Third LegCo that there was no outstanding bill at the time of prorogation.
Improving Electoral System
The passage of the Improving Electoral System (Consolidated Amendments) Bill
2021 (“ Improving Electoral System Bill” ) marked an important milestone in the
history of LegCo and constitutional development of Hong Kong.
In the past few years, some LegCo Members tried every possible means to filibuster
and obstruct the proceedings of meetings in order to delay or even paralyse the
operation of LegCo and bring the Legislature and Hong Kong to a standstill. The
restoration of constitutional order in the Hong Kong Special Administrative Region
(“HKSAR” ) and the faithful implementation of “ patriots administering Hong Kong”
could brook no delay. On 11 March 2021, the National People’ s Congress adopted
the Decision on Improving the Electoral System of HKSAR (“ the Decision” ) and
authorized NPCSC to amend Annexes I and II to the Basic Law on the method for
selecting the Chief Executive and the method for the formation of LegCo and its
voting procedures.
To expedite the implementation of the improved electoral system, the House
Committee (“ HC”) decided to form a subcommittee (“ the Subcommittee” ) to
commence the relevant discussions prior to the Government’ s introduction of the
Improving Electoral System Bill into LegCo. Upon the introduction of the Bill, the
Subcommittee was immediately transformed into a Bills Committee to scrutinize
the Bill in detail. The Subcommittee and the Bills Committee held a total of 17
meetings, spanning 47 hours, on this important and urgent task. The Government
accepted a number of Members’ suggestions and proposed 369 amendments to

3President’s Forewordthe Bill. This reflected a positive interaction between the Executive Authorities and
the Legislature, with checks and balances as well as mutual cooperation. The Bill,
with all the amendments thereto, was passed by LegCo on 27 May 2021 with the
support of Members. With the improved electoral system, the 2021 LegCo General
Election was successfully held on 19 December 2021 and it was the first time in
Hong Kong’ s history that each and every constituency was contested.
Overview of Council business in 2020-2021 session
In the 2020-2021 session, LegCo restored rationality and effectively handled
a huge backlog that had been long outstanding, including a number of
livelihood-related bills.
The Council held a total of 49 meetings in this session during which there were
no further instances of grossly disorderly conduct by Members necessitating
suspension or adjournment of meetings. All agenda items were dealt with in an
efficient and timely manner. For this session alone, a record of 46 Government bills
were passed, which had more than doubled the yearly average of about 20 bills
passed in the past few terms.
Many of the bills passed were conducive to people’ s livelihood, including the
Landlord and Tenant (Consolidation) (Amendment) Bill 2021 which sought to
regulate tenancies of subdivided units, the Employment (Amendment) Bill 2021
which sought to progressively increase the number of statutory holidays to align
with that of general holidays, the Medical Registration (Amendment) Bill 2021
which sought to provide a new type of registration for non-locally trained medical
practitioners to practise in Hong Kong, the Smoking (Public Health) (Amendment)
Bill 2019 which sought to prohibit e-cigarettes and heated tobacco products, and the
Waste Disposal (Charging for Municipal Solid Waste) (Amendment) Bill 2018 which
sought to establish a charging scheme for the disposal of municipal solid waste.
Members were also concerned about the well-being of the public, and two
Members introduced their bills respectively in the session. Both bills were passed
without amendments, including the Waterworks (Waterworks Regulations)
(Amendment) Bill 2021 which sought to combat overcharging of water charges
by landlords from tenants of subdivided units, and the Organized and Serious
Crimes (Amendment) Bill 2021 which sought to provide law enforcement officers
with more investigative and enforcement powers to combat illegal trade in
endangered species.
The Council also dealt with 324 items of subsidiary legislation through
negative or positive vetting procedure, two proposed resolutions on judicial
appointments, and 1 644 Members’ questions seeking oral or written replies
from the Government.

Legislative Council Annual Report 2020-2021In the last session, the Council had no opportunity at all to debate Members’
motions not intended to have legislative effect due to a huge backlog of agenda
items. As LegCo finally returned to the right track in this session, a total of 35 such
motions covering a wide range of issues of public concern were debated, of which
30 were passed with or without amendments and five were negatived.
Amending Rules of Procedure
The effective functioning of LegCo is of particular importance to society and it is
necessary to ensure that LegCo would not cease operation as a result of the severe
epidemic. In this connection, the Council passed a motion under Article 75 of
the Basic Law (“ BL”) at the meeting of 13 January 2021 to authorize Panels, Bills
Committees and subcommittees to hold remote meetings by videoconferencing.
As such, committees are able to continue to perform their functions under the Rules
of Procedure (“ RoP” ) and the House Rules (“ HR”) while observing social distancing.
On the other hand, the Committee on Rules of Procedure (“ CRoP” ) also conducted
a comprehensive review of RoP and HR to address a number of unresolved issues,
including frequent filibustering at meetings of the Council and its committees,
the lengthy election process of committee chairmen, the disruptions to meetings
due to grossly disorderly conduct of Members and abuse of procedures, and the
negative impact on the operation of committees due to their exceedingly large
membership sizes. In addition, preparations were also needed to cater for the
increased membership of the Seventh LegCo from 70 to 90 Members. Amendments
were proposed to the relevant provisions to address the above matters.
On the recommendations of CRoP , the Council passed three proposed
resolutions under BL 75 to amend the relevant provisions of RoP , and HC
approved consequential amendments to HR. These amendments sought to
ensure the orderly, effective and proper conduct of business by the Council and
its committees. Details of the amendments are set out in the relevant section in
this Annual Report.

5President’s ForewordThe Council also passed the Legislative Council (Disciplinary Sanctions and Remote
Sitting) (Miscellaneous Amendments) Bill 2021 at the meeting of 15 September
2021 to define LegCo’ s power to impose financial penalties on individual Members
who are suspended from the service of LegCo due to their grossly disorderly
conduct or whose absence from a Council meeting without valid reasons caused
an adjournment of LegCo due to a lack of quorum. The Bill also allows meetings of
the Council or its committees be conducted remotely in exceptional circumstances.
Overview of the work of Finance Committee
During the session, the Finance Committee (“ FC”) performed its functions
efficiently in scrutinizing and approving public expenditure proposals presented
by the Government to ensure the proper use of public money.
FC held 48 meetings spending about 127 hours. While the total numbers of
meetings and meeting hours were less than those in the previous session, the
Committee approved 120 financial proposals in this session, which is a record high
in this term of LegCo.
The approved financial proposals, comprising 63 public works and 57 non-works
proposals, involved a total commitment of $327.8 billion. The main items
approved included the fourth round of funding injection of about $6.4 billion
to the Anti-epidemic Fund, as well as funding provisions for the development
of the Chinese Medicine Hospital in Tseung Kwan O and a new acute hospital at
Kai Tak Development Area, the expansion plans of two other hospitals, and the
development of a new facilities building of the Hong Kong Sports Institute.
Apart from helping the public to tide over the difficulties arising from the
epidemic and approving a number of projects that were closely related to people’ s
livelihood, FC also approved a considerable number of financial proposals which
carry far-reaching significance to the long-term development of Hong Kong,
such as the planning and engineering study for the development of the New
Territories North, the Strategic Studies on Railways and Major Roads beyond
2030, and the funding injection to the Hong Kong Science and Technology
Parks Corporation to support the development of the Hong Kong-Shenzhen
Innovation and Technology Park.
In addition, in light of past operational experience, FC approved at its meeting on
15 October 2021 a number of amendments to the Finance Committee Procedure,
with a view to ensuring the orderly and efficient handling of business by FC and its
two subcommittees.

A positive and interactive relationship between the Executive Authorities and the
Legislature is essential to good governance. Unfortunately, in the last session,
the executive-legislative relationship was so strained that, for example, the Chief
Executive’ s Question Time (“ CEQT” ) held in the form of “ short questions, short
answers” was repeatedly disrupted by the grossly disorderly conduct of some
Members. As such, CEQTs have not been held since June 2019.
Since the executive-legislative relationship improved in this session, CEQT
resumed in March 2021 and Members raised questions on issues of grave
public concern, such as the COVID-19 epidemic, vaccines, and quarantine-free
travel to the Mainland. As rationality has been restored in LegCo, I hope that
the Executive Authorities and the Legislature can continue to join hands in
safeguarding the constitutional order and overall interests of Hong Kong so as
to ensure its long-term prosperity and stability.

7President’s ForewordInteraction with Central Authorities officials
The future of Hong Kong is deeply connected with the national development.
Riding on the opportunity of the beginning of the implementation of the National
14th Five-Year Plan (“ the 14th Five-Year Plan” ), the Central Authorities organized a
delegation to visit LegCo on 23 August 2021 to attend a seminar. The delegation,
comprising senior officials from the Central Authorities and experts from national
think-tanks, delivered speeches and had in-depth and fruitful exchanges with
Members on that occasion.
The seminar focused on discussing the role of Hong Kong in complementing the
implementation of the 14th Five-Year Plan and the opportunities for us to reinforce
and strengthen the city’ s competitive edge. I believe the seminar would help
Members to make recommendations to the Government in a broader perspective
in the future, which would be beneficial to the development of our country and
Hong Kong.

The Seventh LegCo, which commenced in January 2022, has a new composition
and an expanded membership to 90. To accommodate the increasing need for
meeting venues and office space, an expansion project of the LegCo Complex
will begin in mid-2022 with its targeted completion by mid-2025. The LegCo
Secretariat is working closely with relevant Government departments to ensure
that the expansion project will be carried out smoothly while LegCo business in the
Complex can continue as usual. Despite the increase in the number of Members,
no additional resources have been provided to the Secretariat. I would like to take
this opportunity to thank the Secretariat for its dedication and continual provision
of professional services to the Council and offering comprehensive and impartial
advice to Members. The colleagues of the Secretariat were also rigourous in
helping me as President of LegCo to make each and every ruling which was lawful,
sensible and reasonable.
At the time of writing this Foreword, we are in the midst of the fifth wave of the
COVID-19 epidemic. Containing the epidemic, safeguarding public safety and
health as well as stabilizing the Hong Kong community are the overriding missions.
At this critical juncture, all Members of the Seventh LegCo are committed to
working with the Government and the public to fight against the virus. With
wholehearted support of the Central Government and the concerted efforts of
the entire community, we will do our utmost to win this anti-epidemic battle and
make Hong Kong shine again!

The Basic Law of the Hong Kong Special Administrative Region (“ HKSAR” ) stipulates
that the HKSAR shall be vested with legislative power and the Legislative Council
shall be the legislature of the Region.
Powers and functions
Pursuant to Article 73 of the Basic Law, the Legislative Council of the Hong Kong Special Administrative Region shall exercise the following powers and functions:

o enact, amend or repeal laws in accordance with the provisions of the Basic
Law and legal procedures;
•T
o examine and approve budgets introduced by the government;
•T
o approve taxation and public expenditure;
•T
o receive and debate the policy addresses of the Chief Executive;
•T
o raise questions on the work of the government;
•T
o debate any issue concerning public interests;
•T
o endorse the appointment and removal of the judges of the Court of Final
Appeal and the Chief Judge of the High Court;
•T
o receive and handle complaints from Hong Kong residents;
•I
f a motion initiated jointly by one-fourth of all the members of the Legislative
Council charges the Chief Executive with serious breach of law or derelictionof duty and if he or she refuses to resign, the Council may, after passing amotion for investigation, give a mandate to the Chief Justice of the Court ofFinal Appeal to form and chair an independent investigation committee. Thecommittee shall be responsible for carrying out the investigation and reporting its findings to the Council. If the committee considers the evidence sufficientto substantiate such charges, the Council may pass a motion of impeachmentby a two-thirds majority of all its members and report it to the Central People’ s
Government for decision; and

o summon, as required when exercising the above-mentioned powers and
functions, persons concerned to testify or give evidence.

According to the Basic Law, the Legislative Council (“ LegCo” ) of the Hong Kong
Special Administrative Region shall be constituted by election. The Sixth LegCo
comprises 70 Members ,1 of whom 35 were returned by geographical constituencies
through direct elections and 35 were returned by functional constituencies. The election for the Sixth LegCo was held on 4 September 2016. The sixth term of office commenced on 1 October 2016. The President of LegCo is elected by and from among the Council’ s Members.
The original end date of the Sixth LegCo was 30 September 2020. In view of the severe COVID-19 epidemic situation, the Government postponed the general election for the Seventh LegCo. On 11 August 2020, the Standing Committee of the National People’ s Congress (“ NPCSC” ) decided, pursuant to the relevant
provisions of the Constitution of the People’ s Republic of China and the Basic Law,
that after 30 September 2020, the Sixth LegCo is to continue to discharge duties for not less than one year until the Seventh LegCo begins.

Legislative Council Annual Report 2020-2021In March 2021, the National People’ s Congress passed the Decision on Improving
the Electoral System of the Hong Kong Special Administrative Region (“ the
Decision” ) and authorized the NPCSC to amend Annex I to the Basic Law on
Method for the Selection of the Chief Executive of the Hong Kong Special
Administrative Region and Annex II to the Basic Law on Method for the Formation
of the Legislative Council of the Hong Kong Special Administrative Region and its
Voting Procedures.
To implement the Decision, the Improving Electoral System (Consolidated
Amendments) Ordinance 2021 was enacted by LegCo in May 2021. Pursuant
to that Ordinance, the general election for the Seventh LegCo was held on 19
December 2021. In accordance with section 4(3) of the Legislative Council
Ordinance (Cap. 542), the Chief Executive in Council has specified 1 January 2022 as
the commencement date of the Seventh LegCo. Pursuant to Article 69 of the Basic
Law, the Seventh LegCo will last for four years from the date of its commencement.
The Seventh LegCo is composed of 90 Members, with 40 Members returned by the
Election Committee, 30 Members by functional constituencies and 20 Members by
geographical constituencies through direct elections.

Legislative Council MeetingsMeetings of the Legislative Council (“ LegCo” ) are open to the public and may be
conducted in Cantonese, English or Putonghua, with simultaneous interpretation
and sign language interpretation. The proceedings of Council meetings are broadcast live on the Council’ s website, reported by the mass media, and recorded
verbatim in the Official Record of Proceedings of LegCo. The business transacted at regular Council meetings mainly includes tabling of subsidiary legislation, papers and reports; asking of questions for replies from the Government; consideration of bills; and debates on motions.
Tabling of subsidiary legislation, papers and reports
Subsidiary legislation refers to any proclamation, rule, regulation, order, resolution, notice, rule of court, bylaw or other instrument made by designated authorities under or by virtue of relevant ordinances and having legislative eff ect. Such
legislation is subject to the Council’ s scrutiny through a positive or negative
vetting procedure. Members or public officers may move motions in the Council to amend subsidiary legislation.
Papers tabled in Council include annual reports of government departments and
public bodies, as well as reports of the Council’ s committees. Members and public
officers may address the Council on these reports.Council meetings held

Any Member may address questions to the Government on its work, either
seeking information on a particular matter or asking for official action with regard
to that matter. The Member must specify whether an oral or a written reply is
required. For questions seeking oral replies, supplementary questions may be put
by any Member to request further elaboration after the public officer has replied.

that they are of an urgent character and relate to matters of public importance.

or amendments to existing legislation for enactmentBills
The Government is primarily responsible for proposing new legislation or
amendments to existing legislation in the form of bills for consideration by the
Council. Subject to certain conditions, Members may introduce bills into the
Council. A bill has to be given three readings for its passage by the Council. A
copy of every bill passed by the Council, certified as a true copy by the Clerk to the
Legislative Council, shall be submitted to the Chief Executive for signature.

Consideration of a bill takes place by way of a series of motions moved, debated and

Before the end of a financial year on 31 March, the Financial Secretary presents to
the Council his Budget for the next financial year commencing on 1 April in the
form of an Appropriation Bill and the Estimates of Expenditure. After the Finance
Committee has examined the proposed Estimates of Expenditure at its special
meetings, the Appropriation Bill is brought back to the Council for consideration
and decision. The Finance Committee held eight special meetings between
12 to 16 April 2021 to examine the 2021-2022 Estimates of Expenditure.

Members perform the functions of scrutinizing bills and subsidiary legislation,
examining and approving public expenditure and monitoring the work of the Government through a committee system.
There are three standing committees of the Legislative Council, namely the Finance
Committee, the Public Accounts Committee and the Committee on Members’Interests. Standing committees, by virtue of section 9(1) of the Legislative Council (Powers and Privileges) Ordinance (Cap. 382), may order any person to give evidence, while all other committees may also have this power, where so authorized by the Council, under section 9(2) of Cap. 382.
There are other committees of a standing nature with specific functions stipulated
in the Rules of Procedure (“ RoP” ), namely the Committee on Rules of Procedure,
the Committee on Access to the Legislature’ s Documents and Records, the House
Committee and Panels.
The Committee on Rules of Procedure reviews RoP of the Council and the
committee system and proposes to the Council such amendments or changes as are considered necessary.
The Committee on Access to the Legislature’ s Documents and Records determines
whether a document or record of the Legislature (or its committee) should be
made available for access earlier than the expiry of the closure period specified in the Policy on Access to the Legislature’ s Documents and Records.
The House Committee considers any matters relating to the business of the Council and monitors progress made in studying bills and subsidiary legislation. Bills and subsidiary legislation that require more in-depth study are scrutinized respectively by Bills Committees and subcommittees, and these committees would report their deliberations to the House Committee.
In addition, a petition presented to the Council will be referred to the House
Committee under RoP 20(6) if the request for the petition to be referred is supported by no less than one half of all Members of the Council. The House Committee shall decide the manner of consideration of the petition and may present a report to the Council after the consideration of the petition.
The committees that monitor and examine policy issues are called Panels. There are
currently 18 Panels, the formation and terms of reference of which were approved by the Council on the recommendation of the House Committee.
Apart from the above, an investigation committee may be established under RoP
49B(2A) (Disqualification of Member from Office) upon the moving of a censure motion under RoP 49B(1A). After completing its work, the investigation committee is required to report to the Council and is dissolved after tabling of its report.
Select committees may be appointed by the Council for in-depth consideration of
matters or bills.

The Finance Committee is one of the three standing committees of the Council. It
scrutinizes and approves public expenditure proposals submitted by the Financial
Secretary (“ FS”). Each year, upon FS’ s presentation of the Appropriation Bill to
the Council, the President refers the Estimates of Expenditure to the Committee
for examination and the Committee holds a series of special meetings for this
purpose. After the Appropriation Bill has been passed, the Committee carries out
the function of approving proposals to change the approved Estimates. Besides,
the Committee approves proposals from FS to expend money from certain Funds1
established under section 29 of the Public Finance Ordinance (Cap. 2) pursuant to
the Resolutions on the Funds.

•The Committee deliberated and approved 120 financial proposals involving a
total commitment of about $327.8 billion;1
•The major financial proposals approved by the Committee included:
-public works projects such as site formation and infrastructure works for
Tung Chung New Town Extension costing about $19.3 billion; and projects
costing about $41.6 billion for the construction of a new acute hospital and
a Chinese Medicine Hospital, and expansion of two other hospitals;
-non-works proposals such as injection of $4.75 billion into the Innovation
and Technology Fund and provision of a non-recurrent funding of about
$1.7 billion to support the operation and implementation of the future
strategy for Ocean Park; and
-establishment proposals including creation of three permanent directorate
posts and 26 supernumerary directorate posts;
•The Committee held a series of special meetings comprising 21 sessions
between 12 to 16 April 2021 to examine the 2021-2022 Estimates of
Expenditure;
•Prior to the special meetings, members raised a total of 3 287 written questions
seeking written replies from the Government on the Estimates of Expenditure.
A total of 53 supplementary questions and requests for additional information
were referred to the Government for reply after the special meetings. The

amend the Finance Committee Procedure, the Establishment Subcommittee
Procedure and the Public Works Subcommittee Procedure. The amendments
sought to align with the procedures in the Rules of Procedure and House Rules,
improve the clarity of some existing provisions, reflect current practices, and
ensure orderly, efficient and fair disposition of the business of the Committee
and its subcommittees. Among others, major amendments were made to the
procedures on membership of the Committee and its subcommittees, and the

41Chapter 3 Committees1 Given that the Sixth Legislative Council (“ LegCo” ) stood prorogued from 30 October 2021, the
Director of Audit could not follow the usual practice and submit his report on the Accounts of
the Government for the year ended 31 March 2021 (“ Report on Government Accounts” ) and his
Value for Money (“ VFM”) Audit Report No. 77 to the President of LegCo in late October 2021 for
tabling in Council in November 2021. In the circumstances, the Director of Audit had, with the
agreement of the President, the Committee and the Financial Services and the Treasury Bureau,
advanced the submission of the Report on Government Accounts for tabling in Council on
15 September 2021, so that the Committee could consider the Report on Government Accounts
before the prorogation of the Sixth LegCo. As for VFM Audit Report No. 77, the Director of Audit
had sought the Chief Executive’ s approval to defer its submission to the President until the
Seventh LegCo but not later than 7 April 2022 (i.e. the deadline for submission of VFM Audit
Report No. 78). •The Committee also made a special arrangement to consider the Director of
Audit’ s Report on the Accounts of the Government for the year ended 31 March
2021 in this session.1 The Public Accounts Committee’ s Report was tabled in
Council on 20 October 2021.

the Council. It examines the arrangements made for the compilation, maintenance

their conduct concerning claims for the reimbursement of operating expenses or
applications for advance of operating funds. It also considers matters of ethics in
relation to Members’ conduct in their capacity as such, and gives advice and issues
guidelines on such matters, etc.

During the session, the Committee conducted a comprehensive review of RoP and
House Rules (“ HR”) with a view to ensuring an effective and efficient operation of
the Legislature. In the review, amendments to RoP and HR proposed by Members
and matters in preparation for the Seventh Legislative Council were considered.
Upon consultation with Members and the Committee’ s recommendation, a total
of four batches of amendments to RoP and HR were endorsed and approved by

of the Council and considers matters relating to the Council’ s business while
the Council is in session. An important function of the Committee is to decide
the manner of consideration of bills introduced into the Council and subsidiary
legislation tabled in Council or presented to the Council for approval. The
Committee also serves as a focal point for establishing a formal and regular
dialogue with the Government. The Chairman and Deputy Chairman of the
Committee meet with the Chief Secretary for Administration on a regular basis to

47Chapter 3 Committees •The Committee considered 305 items of subsidiary legislation, one other
instrument and 14 proposed resolutions presented by the Government,
and formed 32 subcommittees to study 132 items of subsidiary legislation
(including 128 items of subsidiary legislation subject to negative vetting and
four proposed resolutions which relate to subsidiary legislation subject to
positive vetting). Among the above 128 items of subsidiary legislation, the
Committee referred 61 items which were made under the Prevention and
Control of Disease Ordinance (Cap. 599) to the Subcommittee on Subsidiary
Legislation Relating to the Prevention and Control of Disease set up under
the Committee for consideration; and
•The Committee also considered nine items of subsidiary legislation not
required to be tabled in Council and not subject to amendment, among
which eight items were made under the United Nations Sanctions Ordinance
(Cap. 537).

a non-permanent judge from other common law jurisdictions
of the Court of Final Appeal. The Subcommittee completed
its work in this session and submitted its report to the House
Committee in November 2020.

relation to Sanctions
[Membership list]The Subcommittee was set up under the House Committee
to examine the implementation in Hong Kong of resolutions
of the United Nations Security Council in relation to sanctions
by Regulations made under section 3 of the United Nations
Sanctions Ordinance (Cap. 537) and to follow up the
recommendations made by the previous Subcommittee
appointed by the Fifth Legislative Council. The Subcommittee
was dissolved in December 2020 and submitted its second
report to the House Committee in January 2021.

Region
[Membership list]The Subcommittee was appointed by the House Committee
in March 2021 to study the Decision of the National People’ s
Congress on Improving the Electoral System of the Hong Kong
Special Administrative Region and related issues. Pursuant
to the decision of the House Committee on 19 March 2021,
the Subcommittee was transformed into the Bills Committee
on Improving Electoral System (Consolidated Amendments)
Bill 2021 upon the introduction of the Bill into the Legislative
Council on 14 April 2021.

The House Committee may allocate bills, other than the Appropriation Bill and
bills not referred to the House Committee by the Council, to Bills Committees
for detailed scrutiny. A Bills Committee will consider the principles and merits of
the bill concerned and its detailed provisions, and may propose amendments to
the bill. All Members other than the President may join any Bills Committee. The
chairman of each Bills Committee is elected from among its members. After a Bills
Committee has completed scrutiny of a bill, it notifies the House Committee and
advises the Committee in writing of its deliberations. Bills Committees are dissolved
upon enactment of the bills concerned or as decided by the House Committee.
The maximum number of Bills Committees that may be in operation at any one
time is limited to 16. When more than 16 Bills Committees are formed, a queuing
system will automatically be activated.

The House Committee may appoint subcommittees to assist its consideration
of subsidiary legislation and instruments made under relevant ordinances. A
subcommittee will consider the policy aspects of the subsidiary legislation/
instrument concerned, its detailed provisions and amendments, if any, to the
subsidiary legislation/instrument. All Members other than the President may
join any such subcommittee. The chairman of each subcommittee is elected
from among its members. A subcommittee reports its deliberations to the House
Committee upon completion of scrutiny work. There is no restriction on the
maximum number of such subcommittees operating at any one time.

51Chapter 3 CommitteesPanels
Panels are committees of the Council. They provide a forum for Members to
deliberate on policy matters and study issues relating to the policy areas of their
corresponding bureaux which are of public concern. Items for discussion can
be brought up by members of the Panel, referred to it by the House Committee
or other committees, proposed by the Government, or raised by other Members
following meetings with District Councils or upon receipt of complaints or
representations. Panels also give views on major legislative and financial
proposals before their introduction into the Council or Finance Committee.
A Panel may appoint subcommittees to study specific issues and present reports
to the Council as it considers appropriate. A Panel or its subcommittee may
meet jointly with other Panel(s) or its subcommittee(s) to consider any matter of
common interest to the Panels.
The chairman and deputy chairman of a Panel are elected by and from among
its members.

terms of investment protection and lowering tariffs on goods and services;
•The Panel discussed the progress of the Administration’ s work in promoting
Hong Kong’ s participation in the Belt and Road Initiative. Members called on
the Administration to help Hong Kong’ s business and professional services
sectors seize the opportunities arising therefrom;

2022 CE Election. Members urged the Administration to work closely with the
Electoral Affairs Commission to ensure that the election would be conducted
smoothly;
•The Panel was consulted on a proposed outline of the National Flag and
National Emblem (Amendment) Bill. Members supported the Administration’ s
drafting direction and requested the Administration to step up publicity and
educational work to promote the national flag and the national emblem as
well as the etiquette for displaying the national flag;
•The Panel received briefings by the Chairperson of the Equal Opportunities
Commission (“ EOC” ) and by the Privacy Commissioner for Personal Data
(“PCPD” ) on the work of EOC and of the Office of PCPD respectively;
•The Panel was consulted on the Administration’ s proposed amendments to
the Personal Data (Privacy) Ordinance (Cap. 486) to combat doxxing. Members
supported the proposed amendments and urged the Administration to step
up efforts in combating doxxing acts to protect personal data privacy; and
•The Panel was briefed on the implementation progress of the improved
Administrative Guidelines on Promotion of Racial Equality. Members expressed
concern on whether adequate and timely interpretation services were provided
by public authorities to ethnic minority service users.

Extension. Members supported the funding proposals and expressed views

Subsidy Scheme launched by the Government to subsidize owners of old and
dilapidated domestic buildings in repairing and/or upgrading the drains of
their buildings with a view to addressing rising public concerns on defective
drains amid the COVID-19 epidemic;
•The Panel continued to monitor the implementation of the territory-wide
replacement and rehabilitation (“ R&R” ) programme for underground
stormwater drains. Members supported the adoption of the risk-based
approach under the R&R programme and called on the Administration to
continue conducting pipe condition surveys and investigation for flooding
cases with a view to identifying the possible causes and areas deserving
improvement;
•The Panel examined the progress of the work of the Urban Renewal Authority
on redevelopment. Members called on the Administration to formulate a
more forward-looking policy in respect of urban renewal to expedite the
redevelopment of old buildings; and
•The Joint Subcommittee to Monitor the Implementation of the West Kowloon
Cultural District Project established under the Panel and the Panel on Home
Affairs commenced and completed its work in this session and submitted its
report to the two Panels in October 2021.

The Panel monitors and examines government policies and issues of public
concern relating to economic infrastructure and services, including air and sea
transport facilities and services, postal and weather information services, energy
supply and safety, consumer protection, competition policy and tourism.
Major work
•The Panel continued to monitor the implementation progress of the Three-
Runway System (“ 3RS” ) project at the Hong Kong International Airport (“ HKIA” ).
Noting that the prolonged COVID-19 epidemic had impacted adversely on the
3RS works and revenue of the Airport Authority Hong Kong (“ AAHK” ), members
urged AAHK to take all necessary measures to ensure that the project would be
delivered on time and within budget. Members also called on AAHK to prioritize
recruiting local workers to meet the manpower demand of the project;
•The Panel considered the Administration’ s proposals to enhance Hong Kong’ s
position as a competitive aviation and postal hub in the Guangdong-Hong
Kong-Macao Greater Bay Area, including the provision of various facilities to
support the operation of the Intermodal Transfer Terminal developed by AAHK

67Chapter 3 Committees •The Panel discussed the work plan of the Hong Kong Tourism Board (“ HKTB” )
for 2021-2022. Anticipating that cross-border travel would unlikely be fully
resumed in the short term, members urged the Administration and HKTB to
identify business opportunities and short-term jobs for the tourism industry to
help the industry tide over the difficulties arising from the epidemic;
•The Panel was briefed on the development strategy of Ocean Park (“ OP”). While
members considered it appropriate for OP to re-orient its development focus
to conservation and education, they urged the Administration to ensure that
the future operation of OP could achieve self-sustainability without requiring
further funding from the Government;
•The Panel was updated on the operation of the Hong Kong Disneyland Resort
(“HKDL” ) amid the epidemic. Although members considered that the net
loss of HKDL in 2020 was within expectation, they were concerned about the
long-term financial sustainability of HKDL, taking into account its repeated net
losses over the past years. They called on HKDL to prudently manage costs and
avoid layoffs;
•The Panel was briefed on the 2021 electricity tariff review prior to
implementation. Noting that the tariffs for 2021 would be frozen at the
2020 level, members were disappointed that the Administration was unable
to persuade the power companies to reduce tariffs in the midst of economic
hardship. They requested the Administration to continue to provide electricity
subsidies to the public to alleviate their financial burden; and
•The Panel discussed the results of the Administration’ s review of local auto-fuel
market. Members considered it unsatisfactory that the situation of high
auto-fuel prices had no improvement and called on the Administration to
adopt a new way of thinking to solve the long-standing problem at root.

Major work
•The Panel gave views on the Administration’ s latest waste management
strategies and work, including the proposals to implement a producer
responsibility scheme on plastic beverage containers, a voluntary scheme for
phasing out personal care and cosmetic products containing microbeads, and
a scheme to regulate disposable plastic tableware;
•The Panel discussed the Hong Kong’ s Climate Action Plan 2050, the Clean Air
Plan for Hong Kong 2035, and the Hong Kong Roadmap on the Popularisation
of Electric Vehicles;
•The Panel was consulted on the Ninth Technical Memorandum (“ TM” ) to
further reduce the emission allowances for sulphur dioxide, nitrogen dioxide
and respirable suspended particulates from power plants by 9%, 10% and 6%

Phase IV of the Mandatory Energy Efficiency Labelling Scheme;
•The Panel discussed the Administration’ s measures in relation to protection
of green turtles, management of wild pigs and the Incense Tree Species
Action Plan. The Panel was also consulted on a Members’ Bill proposed by
Hon Elizabeth QUAT to amend the Organized and Serious Crimes Ordinance
(Cap. 455) to strengthen the combat against illegal wildlife trade;
•The Administration consulted the Panel on the Mercury Control Bill for
implementation of the Minamata Convention on Mercury in Hong Kong; and
•The Panel received the Administration’ s briefings on the implementation
progress of measures to enhance the quality of the coastal waters of Victoria
Harbour, and the application of innovative technologies for environmental
protection.

Visit to waste treatment and resource recovery facilities
On 17 August 2021, the Panel visited O•PARK1 (an organic resources recovery
centre), GREEN@TUEN MUN (one of the Recycling Stations focusing on both
environmental protection education and recycling support), Y•PARK (a yard
waste recycling centre) and T•PARK (a sludge treatment facility) to better
understand the work of the Environmental Protection Department on promoting
waste-to-energy and waste-to-resources transformation as well as community
participation in resource recovery.

The Panel monitors and examines government policies and issues of public
concern relating to financial and finance matters.
Major work
•The Panel exchanged views with the Financial Secretary on matters relating to
Hong Kong’s macro-economic situations. Members expressed concerns on
the impacts of uncertainties arising from the global economic and political
situations on Hong Kong’s future economic development, and called on the
Administration to develop strategies to promote Hong Kong’s economic
development in particular to capitalize on the opportunities arising in the
Guangdong-Hong Kong-Macao Greater Bay Area and leverage Hong Kong’s
advantages as an international financial centre;
•During briefings by the Hong Kong Monetary Authority, Members discussed
with the Authority subjects including impacts of the quantitative easing
measures implemented by the United States on the Hong Kong financial
market, and measures introduced by the banking industry to help the public

Legislative Council Annual Report 2020-2021 •The Panel continued to monitor progress of the development of the electronic
mandatory provident funds platform (“eMPF Platform”). Members urged
the Administration and the Mandatory Provident Fund Schemes Authority
to ensure that scheme members could benefit from the savings in scheme
administration costs after the implementation of the eMPF Platform, and to
continue to communicate with the industry to ensure smooth and secure
transition to the new eMPF Platform;
•The Panel was briefed by the Administration on the proposals to create
a supernumerary Chief Superintendent of Police post in and develop a
financial data analytical platform for the Hong Kong Police Force with a view
to strengthening Hong Kong’s anti-money laundering and counter-terrorist
financing regime, and developing financial intelligence and harnessing
advanced technologies in combating increasingly sophisticated financial
crimes. Members supported the proposals and called on the Administration
to step up its efforts in preventing and enhancing public awareness of financial
crimes, particularly those involving the use of information technologies
through Internet and social media;
•The Panel discussed various initiatives for promoting the development of
green and sustainable finance in Hong Kong. Members stressed the need
for the Administration to work with financial regulators in developing
environmental, social and governance reporting framework to enhance
issuers’ understanding of the relevant standards and disclosure requirements
in issuing green finance products, and in exploring Hong Kong’s capacity in
developing as a regional carbon trading centre; and
•The Joint Subcommittee on Issues Relating to Insurance Coverage for the
Transport Sector established under the Panel and the Panel on Transport
commenced and completed its work in this session and submitted its report
to the two Panels in October 2021.

fats and oils, condiments and formula products intended for infants, as well as
partially hydrogenated oils;
•The Panel received from the Administration a briefing on the major findings of
the Second Food Consumption Survey, an update on the implementation of
the Food Surveillance Programme, and a progress report on the enhancement

wastewater from Fukushima Nuclear Power Station on food safety. The
Administration was urged to work out action plans and mitigation measures
in response to emergencies arising from Japan’ s wastewater discharge plan;
•Members discussed with the Administration issues relating to the ventilation
requirement on air change/installation of air purifiers in catering premises for
reducing the risk of virus transmission. Members called on the Administration
to provide support and assistance to the catering trade in the compliance with
the ventilation requirement;
•When receiving a progress update on the implementation of the Private
Columbaria Ordinance (Cap. 630), members expressed long-standing concern
over the slow progress of the Private Columbaria Licensing Board in processing
applications for specified instruments from private columbaria;
•The Panel followed up with the Administration on the implementation progress
of various initiatives under the New Agriculture Policy, including promotion of
the sustainable development of the fisheries industry through the Sustainable
Fisheries Development Fund;
•The Subcommittee on Issues Relating to the Improvement of Environmental
Hygiene and Cityscape established under the Panel commenced and completed
its work in this session and submitted a report to the Panel in July 2021; and
•The Subcommittee to Study Issues Relating to Animal Rights established under
the Panel reactivated its work in January 2021. The Subcommittee completed
its work and submitted a report to the Panel in September 2021.

Major work
•Members actively and closely monitored the Administration’ s measures
for the prevention and control of COVID-19 in Hong Kong. Members raised
at different stages of the epidemic various suggestions on the tightening or
relaxing of the Administration’ s measures regarding immigration control,
compulsory quarantine, viral testing, social distancing and vaccination. As
the epidemic situation had become stable stepping into May 2021, members
urged the Administration to actively discuss with the Mainland authorities the

81Chapter 3 Committees •On prevention, control and treatment of other diseases, members urged the
Administration to ensure adequate supply of seasonal influenza vaccines in
the winter influenza season and consider providing population-wide seasonal
influenza vaccination. In addition to the Administration’ s provision of free
vaccination to Primary 5 and 6 female students for prevention of cervical cancer,
members called on the Administration to launch a catch-up programme for
other young ladies to receive the relevant vaccination. It was also suggested
that the Administration should widen the coverage and lower the cost of
screening services for women-related health problems. For example, the
Administration was requested to provide outreach breast cancer screening
service for women living in the outskirts of town, provide bone mineral density
tests and set a standardized charge for such tests; and
•Regarding the Administration’ s latest round of manpower projection
exercise, some members considered that the projection results had seriously
underestimated the manpower shortage of the relevant healthcare professions.
They called on the Administration to take concrete and effective measures
to address the manpower shortage problem. In this connection, apart from
amending legislation to attract non-locally trained doctors to come to Hong
Kong to practise, the Administration was also requested to discuss with the
universities concerned increase in the number of training places of doctors and
nurses as well as enhancement of their teaching facilities. These members also
requested the Administration to provide manpower projection for specialist
doctors, review and improve the management of the Hospital Authority
and take steps to retain healthcare personnel. Besides, the Administration
was requested to address the problem of oversupply of Chinese medicine
practitioners as revealed by the projection results.

•The Panel took pride in the brilliant performance of the Hong Kong, China
Delegation at the Tokyo Olympic Games and the Tokyo Paralympic Games.

development in Hong Kong, and supported the new facilities building of the
Hong Kong Sports Institute project;
•The Panel supported the Administration’s proposal for the Government and
the Hong Kong Jockey Club Charities Trust to finance jointly the establishment
of a $300 million Sports Science and Research Funding Scheme to enhance
the competitiveness of athletes and their preparation for major international

83Chapter 3 Committees •The Panel was briefed on the use and management of public open spaces
under the Leisure and Cultural Services Department (“LCSD”). Members
welcomed the launching of a five-year plan to transform more than 170
public play spaces under LCSD;
•The Panel discussed the Government’s work on grooming talent and
administrators in the arts and culture sector. Members considered that
suitable training and internship opportunities should be provided for
prospective talent and administrators to facilitate better collaboration in the
arts and culture sector between Hong Kong and the Greater Bay Area;
•The Panel was briefed on the online resources on a one-stop platform
launched by LCSD and the facility improvement works carried out at LCSD
venues during the COVID-19 epidemic. Members made various suggestions
on enhancing and promoting the one-stop platform;
•The Panel supported the funding proposals for the construction works for
two youth hostel projects by the Hong Kong Girl Guides Association and the
Tung Wah Group of Hospitals. Members requested the Administration to
make sustained efforts in easing the housing needs of young people; and
•The Joint Subcommittee to Monitor the Implementation of the West
Kowloon Cultural District Project established under the Panel and the Panel
on Development commenced and completed its work in this session and
submitted its report to the two Panels in October 2021.

87Chapter 3 Committees •The Panel discussed the Cash Allowance Trial Scheme and passed two
motions urging the Administration to closely monitor the impact of the
Trial Scheme on the rent of inadequate housing and the rental market, and
to expeditiously implement rent control of subdivided units by legislation.
In another motion, the Panel urged the authorities to continue launching
the “one-off living subsidy” scheme for certain low income households and
persons who were not covered by the Trial Scheme;
•The Panel discussed two funding proposals with one to inject an additional
funding of $3.3 billion to the Funding Scheme to Support Transitional Housing
Projects by Non-government Organisations and the other to expand the
scope of the Funding Scheme and provide additional subsidy to transitional
housing projects with special constraints;
•When discussing the work of the Task Force for the Study on Tenancy Control
of Subdivided Units, the Panel urged the Administration to mandatorily
require the landlord and the tenant of a subdivided unit to sign a standard
tenancy agreement, which should set out a reasonable notice period for
moving out, provide an option for the tenant to renew the tenancy and
stipulate the responsibility of repair and maintenance of the subdivided unit.
The Government should also restrict the rate of rent increase and tackle the
issue of water and electricity over-charging by unscrupulous landlords; and
•The Subcommittee on Issues Relating to Transitional Housing and Subdivided
Units established under the Panel commenced and completed its work in this
session and submitted its report to the Panel in October 2021.

•The Panel continued to monitor the Government’ s work on developing Hong
Kong into a smart city, including the release of Smart City Blueprint for Hong
Kong 2.0, the launch of the “iAM Smart” platform, the implementation of
multi-functional smart lampposts pilot scheme, and the open data policy;
•The Panel discussed issues relating to the “ LeaveHomeSafe” mobile application
and the progress of “ Health Code” mutual recognition arrangement, including
the conversion of the “ Hong Kong Health Code” to the health code systems of
Guangdong or Macao for health declaration purpose in entering Guangdong

Legislative Council Annual Report 2020-2021 •The Panel examined the findings of the Review on the Governance and
Management of the Radio Television Hong Kong (“RTHK”), and held a
special meeting to follow up with the Administration on the progress of
implementing the recommendations of the Review Report. The Panel passed
a motion urging the Administration to steer the implementation of RTHK’ s
reform in compliance with the recommendations made in the Review Report;
•The Panel discussed the Administration’s policies and measures to support
and promote telecommunications services and technologies in Hong Kong,
with a special focus on the development of the fifth generation (“5G”)
technology. The Panel also discussed the Administration’ s legislative proposal
to provide for the implementation of a number of measures that would be
conducive to the arrival of 5G and Internet of things technologies as well as
those that would promote trade facilitation;
•The Panel discussed the Administration’s proposal to introduce a real-name
registration programme for subscriber identity module (SIM) cards for better
regulation of pre-paid subscriber services and for facilitating the prevention
and detection of crimes; and
•The Panel gave views on the amendments to the Film Censorship Guidelines
for Censors to provide censors with clearer guidance on film censorship
and classification following the implementation of the Law of the People’s
Republic of China on Safeguarding National Security in the Hong Kong
Special Administrative Region. Members supported the revised Guidelines
for Censors.

concern relating to labour, manpower planning, vocational training and education,
and qualifications framework.
Major work
•The Panel was briefed on the Administration’ s latest legislative proposal to
increase the number of statutory holidays (“ SHs” ) by one day in every two
years such that in eight years’ time the total number of SHs would be on a par
with that of the general holidays. Most members urged the Administration to
advance the relevant legislative timetable;
•The Panel welcomed and supported the legislative proposal to allow relevant
employees commuting to or from work under “ extreme conditions” to have
employees’ compensation protection on a par with that under Typhoon
Warning Signal No. 8 or above or when the Red or Black Rainstorm Warning

93Chapter 3 Committees •The Panel followed up with the Administration on its work progress
concerning the abolition of the “ offsetting” arrangements under the
Mandatory Provident Fund System. Members noted the Administration’ s aim
to introduce the relevant bills in the next legislative year as early as possible;
•The Panel discussed the employment support services for job seekers with
employment difficulties, especially those unemployed and underemployed
from industries that were hard hit by the COVID-19 epidemic;
•The Panel discussed with the Administration the employment status of and
protection for digital platform workers. Members urged the Administration to
formulate policies for the employment protection of platform workers arising
from the development of the “ gig economy” ;
•When discussing issues relating to the wage level of low-income employees
and the requirement of “ continuous contract” under the Employment
Ordinance (Cap. 57), members urged the Administration to shorten the review
cycle of the Statutory Minimum Wage rate to an annual basis and to review the
definition of “ continuous contract” under Cap. 57;
•The Panel followed up with the Administration on the occupational safety
at workplace. Most members called on the Administration to expedite the
introduction of the legislative proposal to raise the level of penalty under the
occupational safety and health (“ OSH” ) legislation in order to increase the
deterrence effect on duty holders and improve the overall OSH performance;
•The Panel received an update from the Administration on the latest
occupational disease and health situation. Members called on the
Administration to prescribe COVID-19 as an occupational disease such that
employees would be compensated for incapacity or death resulting from the
COVID-19 infections; and
•The Subcommittee to Study the Setting Up of an Unemployment Assistance
System in Hong Kong established under the Panel commenced and completed
its work in this session and submitted its report to the Panel in August 2021.

The Panel monitors and examines government policies and issues of public
concern relating to the civil service and the staff of government-funded public
bodies and other public service organizations.
Major work
•The Panel was briefed on the implementation of the requirement for civil
servants and government staff appointed on non-civil service terms to take
an oath or sign a declaration to uphold the Basic Law, bear allegiance to the
Hong Kong Special Administrative Region (“ HKSAR” ) of the People’ s Republic
of China, be dedicated to their duties and be responsible to the HKSAR
Government. Members urged the Administration to formulate measures or
establish a mechanism to monitor that serving staff who took the oath/signed
the declaration would genuinely uphold the Basic Law and bear allegiance
to HKSAR. Members also requested the Administration to extend the
oath-taking/declaration arrangements to employees of government-funded

95Chapter 3 Committees •The Panel was updated on the establishment, strength, retirement, resignation,
age profile and gender profile of the civil service. Members expressed
concern about the recruitment and resignation situation in the civil service
upon implementation of the oath-taking/declaration arrangements, and
suggested that the Administration should review the structure and operations
of bureaux/departments and ensure adequate manpower resources to meet
their operational needs;
•The Panel was consulted on the Administration’ s proposal to expand the scope
of Local Education Allowance for eligible civil servants to cover their children’ s
primary and secondary education in the Mainland. Some members called on
the Administration to extend the eligibility for the allowance to civil servants
who were appointed on or after 1 June 2000, and further expand the scope of
the allowance to cover tertiary education in the Mainland until the children of
eligible civil servants reached the age of 19;
•The Panel discussed the provision of medical and dental benefits for civil
service eligible persons. Noting that the Pilot Scheme on Civil Service Chinese
Medicine Clinics was well received by civil service eligible persons, members
urged the Administration to conduct a review of the pilot scheme as early as
practicable so as to improve and expand the provision of services; and
•The Panel continued to follow up with the Administration on the training
and development for civil servants and the establishment of the Civil Service
College. Members supported the Administration’ s proposal to create a new
post of Head of the Civil Service College. They called on the Administration
to organize more training programmes on national studies for civil servants,
and ensure that civil servants had an accurate understanding of the concept
behind the Law of the People’ s Republic of China on Safeguarding National
Security in the Hong Kong Special Administrative Region.

The Panel monitors and examines government policies and issues of public
concern relating to security, public order, public safety, corruption-related matters
and nationality and immigration matters.
Major work
•The Panel followed up with the Administration on its prevention and
response strategies regarding the terrorist threat in Hong Kong. Members
were advised that since the promulgation and implementation of the Law
of the People’s Republic of China on Safeguarding National Security in the
Hong Kong Special Administrative Region, there had been a significant drop
in violent acts. Members also called on the Administration to step up public
education and publicity on counter-terrorism awareness and strengthen
law-abiding value of the public to prevent domestic terrorism from taking
root in Hong Kong;
•The Panel was briefed on the Administration’s latest proposal to introduce
new offences of non-consensual photography of intimate parts, and related
offences. The Panel urged the Administration to take into account the

97Chapter 3 Committees •The Panel discussed with the Administration its policies, measures and
initiatives to enhance fire safety standards and fire protection measures as
well as strengthen the public’s emergency preparedness and evacuation
awareness in case of a fire;
•The Panel was consulted on the basic principles of the relevant legislative
proposals to empower the enforcement authorities to carry out fire safety
improvement works for the owners of old composite and domestic buildings
who had not complied with the statutory requirements, and to recover the
fees incurred from such owners afterwards. Members were advised that the
Administration would, after consulting the Panel, launch a public consultation
exercise on details of the proposals in 2022;
•The Panel welcomed and supported the Administration’s proposal to
implement the co-location arrangement at the redeveloped Huanggang Port
to enhance the handling capacity of the control point and facilitate travel
convenience to cross-boundary passengers; and
•The Panel was updated on the Administration’s progress of the application
of innovation and technology to enhance law enforcement capabilities and
improve the services for the public.

Major work
•The Panel was briefed in April 2021 on the details of the MTR fare adjustment
for 2021 under the Fare Adjustment Mechanism (“ FAM”). According to the
FAM formula, the MTR Corporation Limited (“ MTRCL” ) would reduce fare by
1.7% in 2021, and the total fare adjustment rate of +1.58% from 2019 and
2020 to be recouped in 2021 would be carried forward. In late May 2021,
the Administration informed the Panel that as the Census and Statistics
Department announced on 28 May 2021 that the year-on-year change in
the Composite Consumer Price Index for December 2020 was revised from
-0.7% to -1.0%, MTRCL had thus revised the 2021 overall fare adjustment
rate to -1.85% according to the FAM formula. Members pointed out that
the public was very concerned about the huge income generated from the
granting of land resources to MTRCL for property development, and called

tolling system (“ FFTS” ) at government tolled tunnels and Tsing Sha Control
Area in around end 2022 by phases to ensure a smooth transition from the
existing booth-mode toll collection to the boothless mode under FFTS. The
Administration agreed to strive to compress the implementation timetable
as appropriate at the request of members. The Administration introduced a
bill into the Council in March 2021 to provide the requisite legal backing for
implementing FFTS at Tolled Tunnels. The bill was subsequently passed on
23 June 2021;
•The Panel was consulted on a number of infrastructural projects, including
the Universal Accessibility Programme; Flyover from Kwai Tsing Interchange
Upramp to Kwai Chung Road; Hong Kong-Zhuhai-Macao Bridge–funding
support for Main Bridge; Route 11 (section between Yuen Long and North
Lantau)–Investigation; and Replacement of Traffic Control and Surveillance
System at Lion Rock Tunnel;
•The Panel was also consulted on the upgrading of passenger ancillary
facilities and application of technology on public light buses, review of
the Public Transport Fare Subsidy Scheme, and the proposed creation of
six permanent posts in the Highways Department to take forward projects
under the policy initiative of “ Walk in Hong Kong” and other projects. In
addition, the Administration briefed members on the traffic and transport
strategy study in October 2021;
•The Subcommittee on Matters Relating to Railways established under the
Panel commenced and completed its work in this session and submitted its
report to the Panel in October 2021; and
•The Joint Subcommittee on Issues Relating to Insurance Coverage for the
Transport Sector established under the Panel and the Panel on Financial
Affairs commenced and completed its work in this session and submitted its
report to the two Panels in October 2021.

105Chapter 3 Committees •Members welcomed the Administration’ s decision to, after two rounds of
exchange of views with the Panel on the subject in this session, introduce a
mandatory reporting mechanism on child abuse cases. They requested the
Administration to expedite the legislative work, put in place a clear threshold of
reporting and accord sufficient protection to safeguard reporters’ interest, and
also take forward the Law Reform Commission of Hong Kong’ s recommendation
to introduce a new offence of “ failure to protect” for better protection of
children and vulnerable persons who were at risk of being seriously abused;
•In the face of an rapidly ageing population, the Panel made suggestions to
the Administration on community and residential care services for the elderly,
which included purchasing residential care places in the Guangdong-Hong
Kong-Macao Greater Bay Area for Hong Kong elders on the Central Waiting
List; expanding the Community Geriatric Assessment Service of the Hospital
Authority to all residential care homes for the elderly (“ RCHEs” ) ; strengthening
the planning and development, and monitoring of the service quality (including
drug management) of RCHEs; and formulating short-, medium- and long-term
goals for various community care services;
•On support for other underprivileged groups in the community, the Panel
urged the Administration to enhance its preventive, supportive and specialized
services to combat domestic violence and sexual violence; strengthen the
provision of child care services, rehabilitation services for children with special
needs in kindergartens or kindergarten-cum-child care centres and services for
at-risk youth; and enhance the support for students with hearing impairment.
The Administration was also requested to revert to the Panel in the next
Legislative Council term on the outcomes of the respective consultancy studies
on support for carers and developing a Central Databank on Children;
•To alleviate poverty, the Panel called on the Administration to analyze the
poverty situation of the unemployed persons under the epidemic and
implement targeted measures to lift these persons out of poverty; conduct
a comprehensive review of the Comprehensive Social Security Assistance
Scheme; and advance the implementation of the initiative of combining the
Normal Old Age Living Allowances (“ OALA” ) and Higher OALA;
•The Panel gave views on the Administration’ s proposal to amend Schedule 2
of the Social Workers Registration Ordinance (Cap. 505) so that a person
convicted of any offence endangering national security shall be disentitled
from being or continuing to be a registered social worker. Members supported
the broad direction of the proposal and went further to suggest an increase
in the number of lay members appointed by the Chief Executive to the Social
Workers Registration Board to enhance the Board’ s public accountability and
credibility; and

The Legislative Council operates a Redress System to receive and handle
complaints from individual members of the public and deputations who are aggrieved by government actions or policies. It also deals with public representations on government policies and legislation, as well as other matters of public concern.
Members take turns, in groups of seven, to be on duty each week to oversee the
Redress System, and to receive and handle representations of and complaints made by deputations. During their duty week, Members also take turns to undertake “ward duty” during which they meet with individual members of the public and
provide guidance to staff on the processing of cases.

Waiving of fees for staying in temporary accommodation sites for
compulsory quarantine
A deputation sought Members’ assistance on the difficulty of Hong Kong residents
returning from the Mainland in fulfilling the Government’ s requirement for paying
fees for accommodation and meal arrangements during their stay in temporary
accommodation sites for compulsory quarantine. According to the deputation,
those residents who had lost their means of living in the Mainland had to return
to Hong Kong. Notwithstanding their explanation about the difficulty in settling
the payment owing to their financial hardship, the Government continued to
issue demand notes to them, indicating that civil proceedings might be instituted
for their failure for payment. In view of the plight faced by those residents, the
deputation called on the Government to waive such payment. Subsequent to the
case conference held with Members, the Administration undertook to exercise
discretion to waive the payment of those who had genuine financial hardship and
could successfully apply for the Comprehensive Social Security Assistance.
Enhancement to online application system
A complainant sought a Member’ s assistance on the inconvenience encountered
for submission of electronic application forms under the Working Family
Allowance Scheme. According to the complainant, when submitting electronic
application forms, applicants had to either pay subscription fees for Hongkong
Post electronic certificates or get ready printers for printing out the declaration
pages for signature, which brought about inconvenience to applicants. Since the
said inconvenience would dampen applicants’ initiative to submit applications via
electronic means which went against the Government’ s advocacy for reducing
paper consumption, the Member took up the complainant’ s concern with the
Administration. In response, the Working Family and Student Financial Assistance
Agency undertook that enhancement to its online application system would be
made by August 2021, allowing applicants to digitally sign and submit electronic
application forms free of charge.

A complainant expressed grave concern that new arrivals to Hong Kong, due to
their unfamiliarity with the local situation, might face the risk of being evicted by
mortgagees who had not consented to the lease of mortgaged real estates when
leasing residential properties. A Member took up the complainant’ s concern with
the Administration. In response, the Administration advised that the information
on the lease of mortgaged real estates was available on the websites of the Estate
Agents Authority and the Government of the Hong Kong Special Administrative
Region. Yet, since new arrivals might not be aware of such, the Member urged the
Administration to consider including such information in the Service Handbook
for New Arrivals to facilitate new arrivals’ reference and their making of informed
decision before leasing residential properties. Upon the Member’ s repeated
requests, the Administration undertook to include such information in the
forthcoming edition of the Service Handbook for New Arrivals.

A seminar on the National 14th Five-Year Plan was conducted by relevant Central Authorities on 23 August 2021. It was attended by Members, officials of the Liaison Office of the Central People’ s Government in the Hong Kong Special Administrative
Region and some staff members of the Legislative Council Secretariat. It was the first time for leaders of the Central Authorities and experts of national think tanks to visit the Legislative Council. The seminar allowed Members to exchange views on the long-term development of the country and Hong Kong.

The End-of-term Dinner for the Sixth Legislative Council was held on 25 October 2021.
The dinner was attended by 101 Members and guests, including the Chief Executive,
Executive Council Members and senior government officials.

activities with consular officials, district and charitable
organizations, and public officers/senior government officials
The President and Members receive visitors and visiting dignitaries referred
by government departments and consuls-general in Hong Kong as well as
parliamentary organizations, and brief them on the work of the Legislative
Council and the latest developments in Hong Kong. These visitors include
members of overseas legislatures, political and business leaders, government
officials as well as prominent people from international organizations and
renowned institutions.
The President hosts luncheons for consular officials and public officers/senior
government officials respectively, to enhance relationship and communication.
In addition, the Legislative Council normally hosts a tea reception each year for
Members and Boards of Directors of six charitable organizations to meet and
discuss issues of mutual concern in a relaxed atmosphere.
Members also exchange views on the work of the Legislative Council as well as
matters of mutual interest with District Council members and Heung Yee Kuk
Councillors, through regular meetings and luncheons. Matters raised at these
meetings which require follow-up actions will be referred to the relevant Panels
or the Public Complaints Office.
During the session, the meetings and liaison activities above were not held for
observing social distancing due to the COVID-19 epidemic.

123Chapter 6 Public Engagement
The Legislative Council seeks to engage with the public and enhance public
understanding of its work. A range of education, visitor, and online services are
available to bring up-to-date information of the Council to the public. The Council
has also connected with the public via its website and other social media channels.
Education and visitor services
A wide range of education and visitor services provided for the public in the
Legislative Council Complex are designed to give participants the opportunity to
meet and engage with Members. Members conduct guided tours of the Complex
and participate in education activities held for schools following the tours such
as role-play on the work of the Council and story-telling. Under the Meeting
with Members programme, Members hold discussions with students on topics
relating to the work of the Council and social issues. Members’ interaction with
students is further enhanced with the integration of music performance given by
school and youth music groups into the programme. Members also attend mock
Council debates organized by youth organizations in the Complex to share with
participants their experience as legislators. During the session, some activities were
switched to online mode as face-to-face interaction with Members and on-site
activities could not be arranged under the suspension of public services in the
Complex and for observing social distancing due to the COVID-19 epidemic.
Online services
Various types of information of the Legislative Council are provided through
the use of the Legislative Council Website and mobile application to keep the
public abreast of the latest development of Council business. To enhance the
dissemination of information, the video records of open meetings and activities
of the Council and its committees are posted on the YouTube channel , and the
relevant photos are uploaded to the Fl ickr album for viewing and sharing. The
mobile application with functions such as “ Press Release” , “Latest Publications”
and “Push Notification” provides the public using mobile devices a quick access to
the most up-to-date information about the Council.

The Legislative Council Commission
The Legislative Council Commission ( “the Commission” ) is a statutory body
established under The Legislative Council Commission Ordinance (Cap. 443).
Chaired by the President of the Legislative Council and comprising 12 other Members (Cap. 443 states that the Commission may have no more than 13 members, including the Chairman), the Commission exercises managerial and financial functions in providing, through the Legislative Council Secretariat, administrative support and services to the Council independent of the Government. Five committees have been appointed by the Commission to carry out specific delegated functions. These are: the Committee on Personnel Matters ,
the Committee on Members’ Operating Expenses, the Committee on Facilities
and Services, the Committee on the Use of Legislative Council Square and the Appeals Committee on the Use of Legislative Council Square .

12 October 2016 Pursuant to the judgments of the Court of First Instance of the High Court
(“CFI” ) on 15 November 2016 and 14 July 2017, six elected Members
were disqualified from assuming the office of Members of LegCo since
12 October 2016. CFI’ s judgments were affirmed on appeal.
11 March 2018 Four vacancies were filled following the LegCo by-election held on 11
March 2018.
25 November 2018 One vacancy was filled following the LegCo by-election held on 25
November 2018.
17 December 2019 Pursuant to the judgments of CFI on two election petitions on 2 and
13 September 2019 and the determination made by the Appeal
Committee of the Court of Final Appeal on 17 December 2019, two
